What Is Domestic Violence in Arizona?

Under Arizona law, domestic violence is defined as any criminal act that is committed by one family or household member against another. This includes acts of violence, threats of violence, and other types of criminal behavior. In order for an act to be considered domestic violence, it must be committed against a family or household member.

Family or household members include:

  • Spouses
  • Former spouses
  • People who live together or used to live together
  • People who are related by blood or marriage
  • People who have a child together
  • People who are in a romantic or sexual relationship

It is important to note that domestic violence is not a specific criminal charge in Arizona. Instead, it is an aggravating factor that can be used to enhance the penalties for other criminal charges. For example, if you are convicted of assault, but the assault was committed against a family or household member, you may face enhanced penalties.

Domestic Violence Restraining Orders

Victims of domestic violence can obtain a restraining order, also known as an order of protection, to protect themselves and their children from further harm. There are two types of restraining orders in Arizona: emergency orders of protection and orders of protection.

Emergency orders of protection are available to victims of domestic violence who are in immediate danger. These orders can be obtained without the abuser being present and are valid for up to one week. To obtain an emergency order of protection, you must show that you are in immediate danger of domestic violence.

Orders of protection are available to victims of domestic violence who are not in immediate danger. These orders can be obtained after a hearing in which both parties have the opportunity to present evidence. Orders of protection are valid for up to one year, but they can be renewed. To obtain an order of protection, you must show that you have been a victim of domestic violence.

Restraining orders can provide a number of protections to victims of domestic violence. For example, a restraining order can order the abuser to stay away from the victim and the victim’s children. It can also order the abuser to move out of the victim’s home and to stay away from the victim’s workplace and school. In addition, a restraining order can order the abuser to have no contact with the victim, including by phone, email, or social media.

Restraining orders can also provide temporary custody of the victim’s children and order the abuser to pay child support. In addition, a restraining order can order the abuser to surrender any firearms and to pay for any medical expenses or property damage that resulted from the domestic violence.
